Jeff Stacy-why I think he shouldn't have been charged

Expanding on another thread, in response to a request from bangoskank, I will now explain why I thought that Jeff Stacy shouldn't have been criminally charged.
First off, regular readers of my comments know that I feel, due to case law, most of these preds should not have been charged. No real victim, no verifiable chain of custody for the chatlogs, scumbag vigilantes probably editing chatlogs, Chris Hansen acting as an agent of the police with no Miranda warning, cops taking their orders from PJ and Hansen, take your pick...legally speaking, these cases were an absolute mess. Watch the 20/20 segment about TCaP. John Roach beautifully articulates my exact sentiments about all TCaP cases.
Additionally, I believe laws prohibiting soliciting a minor for sex run afoul of the First Amendment, and I would love SCOTUS to have a look at them. As long as it's just talking and nothing more, I believe that it is protected free speech. I'm not saying it isn't sleazy, but there's all sorts of sleazy speech protected by the First Amendment.
Now, with all that out of the way, I'll talk about Stacy himself, and why I think he should have never been charged with anything.
In TCaP, there are pedophiles looking for kids, and there are opportunists just looking for sex where ever they can get it, regardless of the age of the potential partner. Stacy isn't a pedophile, and he doesn't exactly fit in the opportunist category, either. He's just a loser.
We all have similar desires. And, while most of us may think that the desires of the Jeff Stacys of the world are invalid or irrelevant doesn't mean that those desires don't exist or don't need an outlet. No one wanted to be physical with Jeff Stacy; he was a virgin when he walked in to the sting house, and the smart money says he's still a virgin today. He finds someone to catfish him and lead him to believe that someone finally wants to be with him, and he gets a little crazy as most of us would in a similar set of circumstances. If we're stranded in the desert and dying of thirst and someone offers us water, we're not going to critique the water or ask where it came from; we're just going to drink it, and drink it hard and fast. That's what Stacy was doing. I'm not saying it's right. But, there's what's right and there's what is.
Chris had a pre-set list of questions he asked pretty much every predator. One of those questions wasn't "can't you get a girl your own age?". In Stacy's case, the answer to that particular question would be a resounding "no" (assuming Stacy's embarrassment wouldn't prevent him from being honest with this quesiton).
Look at Stacy when he walks in the house. He's stiff and frigid and pretty much scared to death. He doesn't being to loosen up until he realizes he's been had and there's no sex in his immediate future. If there really were an underage girl there, I doubt anything would have happened.
It goes against the Hansen/PJ narrative against the "indomitable threat" angle that is so good for TV ratings, but no one seems to ask if a 13-year-old girl would even want to have sex with Jeff Stacy. The answer to that question is no, and Stacy is clearly incapable of rape. So, even if he weren't catfished, no sex would have occurred.
The point I'm trying to make here is that Stacy wasn't a threat to anyone. He's just a pathetic loser, an easy mark who got caught up in this and it just made his life worse than it already was. His "crimes", if you can call them that, were victimless and hypothetical, and he didn't deserve any criminal charges, let alone deserve to do any time.
His "suicide attempt" may have been a half-assed effort to get attention. But, if I were Jeff Stacy today I think I would seriously consider suicide for real. On top of everything else he had going against him, adding "convicted felon" to all of that, and he'll never get to build a good life for himself.
I feel bad for him...even though he makes me laugh.
