I would think it would be, but I don't know for sure. If it's not, then I think that's fucked up and inconsistent. Also... if it's not, do you agree with that law?

The courts and legislation has a million cases about this. Not really anything most people are confused about.

I actually have that one. I bought it in a used record store in Germany back in the late 90's. It has never been opened out of the cellophane and there were stickers over the naughty bits. As far as I can remember, it's in a box somewhere in my garage. I'm just going to assume it's worth something so I'm on the fence about just pitching it. However, it does seem to technically be CP so selling it would be weird. The girl in the picture (who is obviously now an adult) says she has no regrets about posing for it. Although I do think Meine and the rest of the band kind of regret it. Then again, there are stickers over her stuff and perhaps a buyer would keep it that way. Also reminds me of my time in Germany where there would be collectors markets that used to set up in our USO building on Baumholder once a month. They would sell shit from WW2. Everything from postcards to pictures to medals like Iron Crosses and Wound Badges. They would put stickers over all the Swastikas when they set all of their wares out on tables. Like they were thinking "I know there's really bad shit under this sticker but as long as we cover it up and don't look at it then it's all good."

I haven't seen all the albums in question, but a photo of a naked kid isn't itself child porn, context is important. There are medical books with photos of naked kids - is that child porn as well? I don't think most of the album covers were made to sexually arouse people or feature children engaging in sexual activity. A naked child could have much deeper meaning to someone - e.g. this is how we enter the world, our pure form before society molds us, etc.

If something were child porn because peds are turned on by it, then you couldn't put kids on anything.
