Obviously to anyone who has heard Jim's calls with Cheyanne (or George Down the Hall) there is not much doubt that he is intoxicated. Couple that with the fact that he drove around for a couple hours for what should have been a short drive. Watching his interrogation it's pretty obvious that he's drunk or on something in the beginning and he also pretty much passes out at the end where most people would be nervous, thinking "oh shit what did I do!" or be crying L.L. Armstrong, what it means to be from Maine, tears.
What would have happened if Jim's lawyer would have said to the jury "My client has a serious alcohol problem that has ruined his life. It cost him his marriage and his health, please don't let it cost him his freedom!" He could have proceeded to play an edited version of the phone call, some clips from the interrogation and ended with Jim passed out in the chair. Then, he could have put Jim on the stand where he would have talked about his involvement in the church, his years of teaching children without one complaint (Music Teacher? PFFFFFTTTT!) and then he could have cried and talked about his enrollment in a program and how he's been going to AA meetings.
I honestly think he may have been able to beat the charges. The lawyer could have then come back and argued that the police that arrested him knew he was drunk and that KBI did as well - and they let him endanger himself and everyone else on the road so that they could "look like big shots on TV!"
If ever there was a case where this kind of thing should have been argued it was this one. I mean, although all of that is kind of BS Jim was found guilty anyway so what would he have had to lose?
