Ok, so we know from Lorne's story to Paul (KC's dad) the morning of 08/06/2006 Lorne and his brothers Paul and Roy had been drinking all night. Paul wanted to walk home which Lorne says was 25 miles away because he didn't like Roy, so Lorne decided to drive him home instead of letting him walk.
At 4:50 AM Lorne went offroad in his mother's van, caught some sick air for 15 feet and kool-aid manned into some poor bystanders house. Only Lorne and Roy are in the vehicle which tells us both that Roy accompanied them and they had already dropped off Paul and were on their way back. I'm remembering a different call where Lorne laments to his catfish that he were only a few miles away from home when he fell asleep and the accident happened in Cambridge so that seems to be supported here. This means Lorne had already been driving around an hour at the time he had the accident to drop Paul off at his house 25 miles away and almost make it back.
The cops also showed up about an hour later at 5:45AM. From here, the timeline is not as clear because of issues with the documentation. Lorne insists he was breathalyzed and blew a .0987 that morning, but the accident report does not indicate this happened and neither does his presentencing report for his pedo offense.
He is so stuck on this number though and it would be awful police work not to breathalyse him at some point so I'm guessing this really did happen and took place after the scene was resolved and he'd been arrested and taken down to the station. I will roughly estimate that from the time the police arrived to the time Lorne received the test was probably at least another hour.
So Lorne would've gotten behind the wheel around 3:50 AM and it's not clear when he was tested but my best guess would be around 3 hrs later when he had a .0987 (an hour of driving paul, an hour waiting for the cops and an hour before being tested).
We can tell from the presentencing report that Lorne was drinking bottles of bud lite that night, they found 12 in a box in the van a several others scattered throughout the vehicle all empty. This product is most commonly sold in 12 fl oz bottles with an abv of 4.2% which is on the low side. It should take at least 5-6 of these in an hour to get Lorne's (187lb, Male) BAC to what it was when he was finally tested. BAC goes down by ~.15 per hour for almost everyone so it is actually safe to assume Lorne's BAC was .1437 when he decided to get behind the wheel of a car that night. He would've needed to pound 8-9 bud lites in one hour to achieve that. What I think is far more likely is every single beer in that van (say about 15?) was drank by Lorne over the course of 4-5 hours that night and then he drove afterwards.
So as best I can figure, being "a few sips over" means spending the night pounding ~15 bottles of bud lite and then driving after.
